Our platform: FireOps retains all intellectual property rights in the platform, including software, design, templates, and documentation. Nothing in these Terms transfers any intellectual property rights to you.

7. Confidentiality and Data Security
FireOps implements industry-standard security measures including encrypted data transmission (TLS 1.3), encrypted data storage, role-based access controls, and regular security audits. Our data processing practices are described in our Privacy Policy, which forms part of these Terms.
8. Service Availability and Maintenance
FireOps targets 99.5% uptime but does not guarantee uninterrupted access to the Services. We reserve the right to perform scheduled maintenance with reasonable advance notice. Planned downtime will be communicated via email and the platform status page.
FireOps inspection forms are designed to function offline; however, data synchronisation and report delivery require an internet connection. FireOps is not liable for inspection data not submitted due to connectivity issues that are within your control.
9. Third-Party Services
FireOps integrates with third-party services including Stripe (payment processing), WiPay (Caribbean payments), Supabase (database infrastructure), and others. Your use of these integrations is also subject to the applicable third-party terms of service. FireOps is not responsible for the actions or policies of third-party providers.

FIREOPS IS A SOFTWARE PLATFORM AND DOES NOT ITSELF CONDUCT FIRE INSPECTIONS OR CERTIFY COMPLIANCE WITH ANY FIRE SAFETY STANDARD. YOU REMAIN SOLELY RESPONSIBLE FOR ENSURING THAT YOUR INSPECTIONS AND REPORTS COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS.
IN NO EVENT SHALL FIREOPS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE SUBSCRIPTION FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Termination
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. FireOps may terminate or suspend your account immediately if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law.
Upon termination, you may export your data for 30 days. After this period, FireOps may delete your data in accordance with our data retention policy.
13. Governing Law and Disputes
These Terms are governed by the laws of Jamaica. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Kingston, Jamaica, under the applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
